Terms & Conditions – Donations

General

  1. Bethanie Group Inc (Bethanie or we, our ) is registered as a charity with the Australian Charities and Not for Profits Commission.
  2. Bethanie is licenced to collect donations in Western Australia under licence number CC17699.  Bethanie is not licenced to collect donations in any state of territory other than Western Australia.
  3. By completing a donation via this website you confirm that:
    1. you have read and accepted these Terms & Conditions.
    2. you are making the donation from a location within Western Australia.

Online donations

  1. You can make a donation through this website as a one-off donation or a recurring donation.
  2. All pricing and transactions on this website are stated in Australian Dollars (AUD).
  3. Bethanie:
    1. will not accept anonymous donations;
    2. will apply your donation towards its objects set out in its Constitution, which can be found on the ACNC Website (Objects );
    3. may act in accordance with the legal processes governed by the associated credit card scheme or Bulk Electronic Clearing System (BECS ) regulations;
    4. will provide you with a receipt for each one-off donation you make via this website; and
    5. can provide tax-deductible receipts for approved donations of $2.00 or more.
  4. You may request that your donation is put towards a specific purpose and Bethanie will use reasonable endeavours (provided that such purpose is within the Objects) to direct those funds to that purpose but is not obligated to comply with such requests.

Recurring Donations

  1. The Direct Debit Service Agreement which you can find here [L1]   [TG2]   [L3]   , governs any agreement by you to provide recurring donations to Bethanie.  By selecting ‘monthly donation’, you understand and agree that the Direct Debit Service Agreement will be incorporated into these Terms & Conditions.

Refunds

  1. Bethanie will consider all requests for a refund however is under no obligation to do so.
  2. To request a donation refund you must:
    1. contact Bethanie within 14 days of receipt by phone on 131 151 between 9am and 5pm AWST (Australian Western Standard Time) Monday to Friday or by email to info@bethanie.com.au . Alternatively, you can send a written request to:

    1. provide details of how you made the donation, the amount, the date and the circumstances justifying your request.
  1. If a donation is refunded, the associated tax receipt is no longer valid and should be securely destroyed. Please note it is your responsibility to submit correct receipts to the ATO (Australia Taxation Office).

Donations We Cannot Accept

  1. Bethanie is not licenced to collect donations in any state or territory other than Western Australia.  For this reason, we will not accept:
    1. anonymous donations; or
    2. donations from donors located outside of Western Australia.
  2. Bethanie will not accept donations where we hold a reasonable belief that:
    1. you are in vulnerable circumstances or lack capacity to make a decision to donate; or
    2. accepting the donation would not be consistent with our Objects and/or Values (our values are set out in our Constitution which can be found on the ACNC website ) (Values ).

Privacy & Security

  1. This website is enabled for online donations using a secure donation payment platform which protects your data from misuse, unauthorised access, modification or disclosure in compliance with the Payment Card Industry Data Security Standard (PCI-DSS )].  However, you should be aware that there are risks in transferring information and money online.  For more details on the collection, storage and use of donor data, or how to access or amend your donor data, please see our  Privacy Policy .
  2. We will keep your information confidential, except:
    1. where permitted by law;
    2. for the purposes of this agreement (including to arrange or conduct direct debits or recurring payments with your financial institution);
    3. to address a related query, dispute or claim; and/or
    4. to communicate with you about our Objects.
  3. By completing a donation via this website you confirm that:
    1. you have read and accepted Bethanie’s  which can be found here ; and
    2. you understand that you can cease communication, or access and change your personal information by phone on 131 151 between 9am and 5pm AWST (Australian Western Standard Time) Monday to Friday or by email to info@bethanie.com.au . Alternatively, you can send written notice and queries to:

Variation

  1. Bethanie will not amend the terms of any Direct Debit Service Agreement entered into by you without your written agreement.
  2. Bethanie may otherwise change or modify these Terms & Conditions at any time and you agree to be bound by these Terms & Conditions as changed or modified.  Notice of any changes or modifications will be provided by publishing the revised Terms & Conditions on this website only and separate notification will not be given to you individually.

Interpretation

  1. In these Terms & Conditions, unless the context otherwise requires:
    1. Headings or subheadings are for convenience only and do not affect the interpretation of any provision of this document.
    2. A reference to any agreement or document is to that agreement or document as amended, novated, supplemented or replaced from time to time.

Exclusion of contrary legislation

  1. To the full extent permitted by law, any legislation that adversely affects a right, remedy or obligation of Bethanie, under or relating to these Terms & Conditions is excluded.

Governing Law and jurisdiction

  1. These Terms & Conditions are governed by the Law of the State of Western Australia.

You are able to make a donation to Bethanie in lieu of sending flowers or gift in memory of a loved one. This allows you to acknowledge your loved one whilst making a positive difference.
